Motorcycle Accidents in Maryland
Motorcycle accidents can be especially devastating due to the fact that the riders generally have nothing to protect them at the point of impact. As a result, motorcyclists are more likely to suffer severe and life-threatening injuries. Common injuries reported in these accidents include:
- Spinal cord injuries
- Neck injuries
- Traumatic brain injuries
- Abrasions and contusions
- Dislocations
- Internal injuries
- Ligament and tendon damage
Any type of severe injury following a motorcycle accident can require extensive medical treatment. Unfortunately, motorcycle crash victims often have to go through months of therapy and rehabilitation.
After being harmed in a motorcycle accident, you may have legal options available. In order to file a personal injury claim successfully against another party, you must be able to demonstrate that they were responsible for the accident taking place. This is done by proving that the four elements of negligence existed during the accident. This includes duty, breach, causation, and damages. Maryland is one of five jurisdictions in the country that follows a contributory negligence doctrine. Unlike other states, if a person is injured as a result of an accident that takes place in Maryland, they must be able to prove that the defendant is liable for all of the damages that they suffered. If a victim contributed to the accident in any way, they will not be able to recover any damages following the crash.
