On May 29, 2015, our client, John Bosworth, was operating his vehicle at a low rate of speed while entering a gas station in Bryantown, MD. An employee accelerated from a gas pump without paying attention, and directly in the path of our client's vehicle. Just prior to the impact, Mr. Bosworth saw the vehicle driving straight toward his driver's side door. Mr. Bosworth attempted to accelerate his vehicle to avoid the impact, but the other car collided into the driver’s side rear corner of his vehicle, causing minor property damage to the wheel and quarter panel.

Our client sustained a traumatic disc herniation at L5-S1 with aggravation of underlying degenerative disc disease that was previously asymptomatic. Our client also sustained an aggravation of underlying degenerative disc disease of the cervical spine with the development of post-traumatic cervical radiculopathy. 

Mr. Bosworth had a lumbar discectomy and two-level fusion in March, 2017 that failed. He then had a revision lumbar surgery in April 2019, and now has significant residual permanent impairment.

The jury's verdict soundly disregarded the testimony of the defendant's expert in biomechanical engineering. Confirming the fact that there is no correlation between property damage and impact forces to the degree and extent of bodily injury in a particular individual with heightened susceptibility to injury.
